These terms ("terms") cover your use of kaal.uk (the "site"), run by Kaal ("I", "me"). By using the site or sending a form, you agree to them. My privacy policy explains how I handle personal data.
Services
The site describes my web design services: a free preview before any deposit, paid website builds, optional Kaal Care (hosting and ongoing care), and optional self-host file handover. The exact scope, timeline, deposit, fees and Care terms for your project are agreed separately, for example in a proposal or statement of work. Nothing on the site is a binding contract on its own. A contract only exists once we've both confirmed it in writing.
Eligibility & acceptable use
- Please give accurate information in enquiries and forms.
- Don't misuse the site. That includes probing for vulnerabilities, scraping without consent, uploading malware, harassment or pretending to be someone else.
Intellectual property
Everything on the site (copy, visuals I own, branding and layout) is protected by intellectual property law unless stated otherwise. Please don't reuse or redistribute it without permission, except where fair dealing applies.
Deliverables for paid projects are licensed or transferred as set out in your project agreement. Until then, I keep the rights in concepts I produce. Once you've bought a build under your plan, you own the site's code, assets and content as described in that agreement.
The free preview
When I offer a preview, the delivery time depends on how complete your brief is and on agreeing the scope. The preview itself is free. If you approve the direction and want the full build, a deposit and contract terms apply, as offered to you in writing. Until those are settled, neither of us has any obligation beyond what I've expressly confirmed to you.
Hosting, Kaal Care & domains
I only host client websites through Kaal Care. Care is a paid monthly subscription that includes hosting, a standard domain registration (premium or aftermarket domains are excluded unless agreed separately), DNS and launch setup, and reasonable ongoing changes as described in your Care agreement. Domain renewals are covered while Care is active. If you already own a domain, I can point it at your Care-hosted site instead of registering a new one.
I manage domains registered under Care for as long as the subscription runs. If you cancel Care, I'll transfer that domain to you, subject to registrar rules, any outstanding fees and the transfer process we confirm at cancellation. Domains you already owned stay yours. I only help with DNS while Care is active. After Care ends, renewals and hosting are your responsibility unless we agree otherwise.
Alternatively, you can choose a self-host handover. I deliver the finished source files and reasonable launch guidance for your own hosting provider. Hosting, domain registration and related fees then stay with you. I don't provide hosting outside Care.
Disclaimer
The site is provided "as is". To the fullest extent the law allows, I give no warranties of merchantability, fitness for a particular purpose or non-infringement. External links are there for convenience, and I'm not responsible for third-party sites or tools.
Limitation of liability
Nothing in these terms excludes liability that can't be excluded by law, including for death or personal injury caused by negligence, or for fraud. Subject to that, my total liability arising from these terms or your use of the site is limited to £100, or to what you paid me for services directly related to the claim in the twelve months before it arose, whichever is greater.
Indemnity
You agree to compensate me for reasonable losses caused by your breach of these terms or misuse of the site, except where the law doesn't allow this.
Suspension
I may suspend or restrict access to the site where reasonably necessary for security, abuse prevention or maintenance. For client sites hosted under Care, I may suspend them or take reasonable protective action where needed for security, abuse, non-payment or legal compliance, as set out in your Care agreement.
Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you're a consumer living elsewhere, you may still benefit from mandatory protections under your local law.
